  1. Thanks John. It had a major service at which leaking shock absorbers were noted. At that time it was on a warranty that came with it when I bought it. It was valid for three more days" So the Warranty at that time should provide cover for a claim. "I took out the two-year extended warranty that day. " There must be an implied assumption that the dealer who provided this second warranty deemed the car suitable for cover and there could not have been any existing conditions therefore. So it seems to me that your claim must succeed under either the first warranty or the second warranty !! Have a good nights sleep John. Regards John
  2. Your car may have done 113,000 miles John,but it was approved for Extended Warranty purposes immediately prior to you paying the full warranty premium. In such circumstances the term "wear and tear" is unjust and inequitable and unreasonable and unfair and is nothing short of a cop-out!! Did you email HJ as per my PM ? Regards John

Checked document with my copy Shahpor.Minor changes; * 1.1 change of address of Registered Office. * Warranty service charge......."12 months or " has been inserted before 365 days * Former para 1.6 has been excluded (minor change) * Para 8.1 (f) "£20 " has been increased to "£25" * Last page..para 12 should be numbered 11. All in all it is esentially the same document. You and I seem to be thinking along the same lines,but it needs a suitable authority to declare the correct interpretation of the document. This can be achieved quite simply in my opinion by the insertion of "No claims will be entertained in the event of the vehicle`s odometer exceeding 25,000 miles (12,500 pa ) following the date this policy was effected" The effect of this Shahpor is to give arguably 2 years free motoring.   5. For the avoidance of doubt and misunderstanding, it should be noted that the Warranty Provider is Toyota (GB) PLC (Lexus Division) and the Warranty Administrator is TWG Services Ltd. It should also be noted that the recognised and documented Appeals Procedure(COMPLAINTS PROCEDURE) should be exhausted prior to involving any 3rd party such as CEO`s. Regards John Regards John
  6. I find that the big drawback with my GS 450h is that the rear seatback is fixed. In all other respects it is perfect for my use. Just been to St Andrews and back in total silence, not hanging around and 34mpg. Rgeards John
  7. Seems that we have dissimilar documents Shahpor. Mine was issued to me in September 2016 when I last renewed my Lexus Extended Warranty. Anyway, I have found the wording you referred to on page 6 of my document. Wear and Tear does not appear to be defined within the Warranty Document, so this led me to the Dictionary definition of wear and tear...... "Wear and tear is damage that naturally and inevitably occurs as a result of normal wear or aging. It is used in a legal context for such areas as warranty contracts from manufacturers, which usually stipulate that damage from wear and tear will not be covered." Which leads to the interesting question..How can THE WARRANTY PROVIDER (Lexus) say, On the one hand that it will provide "manufacturers equivalent cover for approved vehicles up to 10 years of age, with less than 140,000 miles on the milometer at point of sale" whilst on the other hand say that, "we will not pay for the cost of repairing or replacing any Protected Part that suffers Mechanical or Electrical Failure as a result of wear and tear." There is little if anything that can be construed as wear and tear within a two year period on a new vehicle, but there is a whole host of matters that can be construed as wear and tear on vehicles that are 10 years of age or have covered 140,000 miles. However in the case of the Lexus Warranty Lexus; * inspects (or is assumed to have inspected) the vehicle prior to accepting it as eligible for warranty cover (and therefore had the opportunity to identify and inform the vehicle owner of matters that would be construed as wear and tear) * charges the sum of £1095 for the inclusion of the vehicle under warranty cover, and * offers "manufacturer equivalent cover for approved vehicles" It is my contention therefore that it is unreasonable and inequitable for Lexus to seek to escape its contractual obligations by referring to a form of words contained in one and a half lines of text on page 6 of a 12 page document and which in my view show a blatant disregard for its contractual obligations and for the owners of Lexus vehicles. I advise OLDTROUT and other Lexus owners if appropriate to *appeal any wear and tear decisions *appeal to the Ombudsman if not satisfied,and *seek legal advice if appropriate. Regards John

  12. PM sent to you John. Looking at the Lexus Warranty wording, my view is that it is not possible for a claim to be both a Protected Part and a Wear and Tear item. In your case the claim cannot be described as Wear and Tear as the Suspension is a Protected Part, which is by definition, included. Good luck. Regards John

But that's just me..." I`m with you on this Jay. In my book it is a necessary requirement, not a courtesy,as is giving clear signals of your intentions to other road users.   18. Lexus is part of Toyota and Toyota is the World`s largest motor manufacturer, bar non. Toyota embraces, Isuzu, Subaru,and Daihatsu. Toyota and each of the subsidiaries mentioned have class leading reliability figures which are consistently in the upper quartile of all figures published worldwide. Mercedes production worldwide does not come anywhere near Toyota and the reliability of Mercedes and its subsidiaries is a myth and based largely upon the W123 and W124 Series. Its mythical status ranks alongside VW for which reliability figures have often not exceeded Ford. I have had 4 Mercedes and 2 Toyotas (Daihatsu and Lexus). The first Merc was a C200 Diesel Manual which needed 4 replacement glow plugs at 30,000 miles The sceond Merc was a C180 Petrol Auto Estate which was fine The third Merc was a C220CDI Auto Estate which needed 2 sets of replacement glowplugs and rusted away before my eyes The fourth Merc is an E 220 cdi Auto estate which is now 13 years old and has done 215,000 miles. It has had one wheel bearing, one Electronic Ignition Switch,one radiator one set of glowplugs and its model (W210) has an unenviable reputation for rusting away at lightning speed. I am fortunate in that rust does not seem to have affected mine. The Mercedes Dealerships which I have used have only wanted my money in return for not providing a service. The large network of Mercedes Indies are making a small fortune as a result of Mercedes inefficiences. The first Toyota was a Yaris 1,3 Auto. It lasted 13 years and not one thing was replaced or went wrong. It is now in my daughter`s hands where it continues to perform in an exemplary fashion. The second Toyota is my Lexus 450h,first registered in July 2010. I have had it now for over 3 years, have done 26,000 miles and it has performed faultlessly. Whilst it is true that Lexus Indies are thin on the ground, Toyota Indies are not and they can service and maintain Lexus vehicles. I know which Manufacturer I would recommend to car buyers !   19. That`s interesting Stephen. I`ve used them for 39 months. Reception girls are fine and welcoming, Tom is excellent, but I`ve never had an acknowledgement from anyone else on any occasion I`ve visited. Mark Mitchell however (owner) always acknowledges every customer he passes regardless of whichever marque he is in. Phone calls have on occasions not been returned and problems not always resolved. Having said that Lexus Chester is in my view a better Dealership than non- Mark Mitchell Dealerships locally. In my lifetime of experience I find that people make organisations more frequently then organisations make people. Regards John

I would just add "Speak to previous owner if possible to ask why he sold the vehicle and what problems did he experience whislt in his ownership" As far as wear on the inside of tyres is concerned, conventional wisdom attributes this to owners trying to straddle speed bumps. Wear can be minimised by driving over the centre of the bump with one wheel and between the bumps with the other. Thus both tyres are "on the flat" when traversing the bumps. Regards John
