Car Had Argument With Lorry

Geez Claire Not good, remember A car is a piece of metal that can be repaired a human is a little bit harder to repair.

As long as now is injured that is main thing, still is PITA I know I felt gutted when someone tried to de-badge the car. Did you get the lorry drivers registration? if so the under the DVLA rules the insurer can get the truck owners details and then start action, also the police can provide it to you when you make a statement, as they did to my mum in her non-accident. It might sound daft but if you loose and it ends up being 50 - 50 you could try a private proesection for the loss, but as long as the police are informed and if they can get the driver for not providing the correct insurence details it could be a criminal act.

I thought your IS was a company car?

No, my IS is on a PCP - I did it that way so I can take the car with me when I leave. So it's all self-funded, my insurance etc.

I got the details of the lorry as he had to stop really. He's just not contacted his company yet to notify them, so my insurance can't establish liability yet. Lexus Edgware came through and have sorted me out a courtesy car anyway, my car's been trailered off to the garage so the damage will be fixed up either way luckily.

Just pleased my son wasn't in the car, and no one was hurt. Feeling a bit more chilled about it now, just hoping it doesn't go 50/50. Will try hard not to let it go that way.

I'll post the piccies of the damage when I sort them out.

apparently DIg now have a dedicated claims specialist.. so when you call you are put in touch with the in house claims specialist... not one of 20

Really sorry to hear of your accident Claire. I certainly know what you will be going through as I had an accident not too long ago and I lost my no claims bonus even though it wasn't my fault. :angry:

I'm insured with DIG (LexusOwnersClub approved insurers) and they are fantastic. Steve, you're right, they have a dedicated person who deals with claims and she's a lovely lady to deal with. As soon as I contacted them, they put me in touch with a repair centre on the same day. She's been on holiday recently and I'm waiting for her response to my query about trying to get my NC bonus back.

Hope you get it sorted soon Claire :)

I know it may seem a stupid question so excuse me if sounding stupid, I'm feeling blonde. Would it be worth contacting the truck drivers company and ask what ios going on as they haven't yet filed a report. I had a similar situation in Hong Kong where a coach hit me and didn't report it, I chased the coach company who were more than interested to hear my story and as it was me chasing their company it helped my claim a great deal ?

Just a thought.

the fact the truck has hit you behind the line of view, means he has pulled out onto you......

therefore he is driving without Due care an attention.....id have involved the police, soon as he started getting narky, as this was a precurser to the troubles already experianced

It's usually very difficult to get the Police out to these sort of accidents (i.e. no injury) unless the road is blocked.

My brother in law came up with a bit of quick thinking when he was hit by a czech lorry on the M25, whose driven suffered a sudden loss of english. He phoned the Police and told them that the carriageway was full of debris :D .

I called the police but they weren't interested as no one was hurt. I wondered if it was worth checking out the driver's tachograph, but again no interest from the police.

I'll be contacting the insurance again later today so will see if he's filed with his insurers yet, if not I'll ring the company direct - cheers for the suggestion Ryan.

Picked up the Yaris courtesy car this morning, it feels like a go-kart!

Claire I would persue the police because he could be driving without insurence, and it could be fraud. MY mum had no accident but a guy claimed she hit his car. Now after a failed prosecution by the CPS due to lack of evidence she is having a private prosecution against her. Fortunatly the old insurence company belives it is fraud. Just fight the police dont always like dealing with the paperwork hence nothing gets done some time.

Should have said you'd just seen someone speeding - they would have had 2 police cars, 3 police bikes and a helicopter out looking for this type of hardened criminal ;)

Unlucky Claire. It shakes you up but it could have been a lot worse. Hope your claim is ok and your repair is perfect first time.

The other driver STILL hasn't reported it to his insurers! I spoke to DIG today and apparently he has up to 3 months to report the accident to his insurers. After that his insurers take a view on what to do...as he's covered by company insurance he's probably not that bothered. DIGs recommended I just wait and see.

Got to find some money to pay my excess, looking down the back of the sofa tonight!!! Why do I get the impression I'll be out of pocket on this one :crybaby:
