Before i get hammered and prejudiced against for being a young male that was involved in an accident where someone drove into him and they are taking him to court for the costs?!?!?!?!?!?!

Seriously tho peeps, i am s**tting myself over this, and have never been in a court when it was me that's involved.

Honestly, am i gonna be prejudiced against for being a young male involved in an accident with a woman in her 40's?

F**k me i feel so :sick::sick::sick::sick::sick:

Being a young driver myself, I would try and be calm and correct when speaking, and dont act like a sterotypical young fella. ie dont fly off the handle like theyre probably expecting you to when she starts feeding them bulls**t about you. :)

i would love to say i have faith in the british justice system but sadly i dont.

As long as your well presented, act proffesionaly and act dignified then i am sure you will be fine.

I will be thinking of ya, and hoping that things go your way! so good luck and tell us how things go!!

Also remember the other side will be tring to bring the worst out of you and prove that you fit the steriotype that will help them win. dont rise to their "claims" or petty words. just be clear and win with the facts! use anything you can as leverage and empasise that your a strong family man etc etc

When your asked a question by anyone look to and answer the JP, or judge if its a higher court.

I got "told off" for answering the person who asked me a question, and I was only there to confirm details about a company car that got nicked.

If you have made any staements make sure you know them inside out - and stick to it

Thanks for the advice peeps, you can bet i'll post up the result, but it probably won't be until late tomorrow eve, as the case is at 2pm, and whichever way it goes i'll need some time to put it behind me!

Listen to your heart? was you @ fault, if yes then the result will be justified. If not trust destiny......thats a good thing!

Stu .......... form someone who is at court almost every week ........... :blush: take my advice !

You will be called a liar ........ and if they have a half decent barrister / lawyer, they will cross examine you ........ and ask you all sorts of things, but remember.

1) Always direct your answer / reply to the Judge, no one else !!

2) Don't get into an argument (they do that to get the aggresive side out of you)

3) ONLY answer what you have been asked, don't answer a question, then waffle on !

4) Only state things that are evidential, and relevent to the case ........ the judge get's bored with things that just go off topic ...... and begins to turn off !

A few years back a woman rear ended me, after I stopped to avoid hitting a kid, who ran into the street. After the insurers found her at fault she then decided to sue me for the damage to her car :tsktsk:

I then counter sued her for whiplash, loss of earning etc.

It was heard at Magistrates Court, not very nice. People are right direct answers to the JP/Judge.

Some how the JP found me 75% liable her 25%???? :duh:

I agree I was harshly treated as I was a young bloke against a single woman.

Only good thing was that as I was counter suing as well, for substantially more than she was seeking even on those ratios I still was "up" enough to go on holiday in St Kitts to recuperate :D

Good luck mate, just some more advice from me... (just incase it hasn't flowed over)

I'm assuming its a madgistates court? rather than Crown?

Best advice, wear a suit, clean shaved.

Be polite, respectful, but assertive - dont be meek and mumble, project and be confident in what your saying without being aggressive.

as has been said, any previous statements you have made, make sure you dont say something different.

Your not a teenager, so age wont be an issue, if you have a clean license, you can use this to counter any 'boy racer' accusation...

it was cancelled, and my solicitor didn't inform me. so i was waiting in court for a hearing that didn't, and wasn't, gonna happen.

so now i have to wait for even longer to get all this sorted out, and to be honest, i am getting pretty annoyed at all the beurocratic bulls*it that seems to make the insurance world go around.
