This is a pretty good site for not getting too involved in this sort of stuff. In this case it did not have to do anything ,because I just did not bother to write when the picture is better than a thousand words.

On a more serious note I really wish people could get over building other people up to a mythical level. We all go to the same place and do the same stuff when we get there. Hard to imagine that the process between our ears is radically different.

Oh I don't know. I think if you look hard enough it's possible that you might spot some subtle differences in the processes between the ears of the likes of say Jeffery Dahmer and Ghandi 🙂

I'm sure I've read of cases of people over the limit being arrested when walking to their cars with keys in hand, or getting into the passenger side of the car, being arrested and convicted under the drink driving laws even though they weren't actually driving.

I don't think it will come to that though because we won't actually be able to buy ourselves a self-drive car, they will only be available from a pool. We will have to buy a monthly subscription to use them. There are already car clubs operating this model (with cars that you need to drive). My local one has 3 pricing options to choose from, depending on what access you want. They buy, service and insure the car. The club member only has to put in fuel and agree to return the car by the agreed time.

The modern route to cheap motoring under a conservative government:

Stolen car

Cloned numberplates

No Insurance

No tax

No MOT

No servicing ( just go steal another ).

No fines

No petrol bills ( see cloned plate ) Just drive away.

It seems the government and these rip off insurance companies may well be forcing more people down that dangerous route.

Most of us honest mugs just pay up and whinge about it.

Chiming in here from a 'former' Lexus NX300 owner. We bought an ES in April of 2023- the insurance was around 600. It got nicked within a month of being parked on our street in West London. Insurers- LVE- paid out the entire cost of the car, whew! We then decided, after about 6 months of debate, to reinvest in a Lexus NX, this time with a steering wheel lock. Insurers quoted us £3.5k- presumably to try and recoup their losses! 

For us, the real issue is with Lexus. They know there is a manufacturing fault- there is a way to ghost unlock the cars in the front quarter panel- and yet they do nothing. Insurers are complicit, as they know there is an issue but don't let anyone know until AFTER the car is purchased and insurance issues- if then at all!

You'd like to think so but the police and courts have very different ideas as any number of drunks sleeping it off in their cars have found out to their detriment. 'In charge' is legally a very broad definition.

I just learnt something new, I didn't know this. Apparently sleeping it off in your car whilst drunk is the same as drink-driving, even if the keys are not in the ignition and you are sleeping in the back and you are on your own driveway.

I don't think that is all correct or clear cut. Section 5, Road Traffic Act 1988 requires the offence to be on a road or other public place. I doubt a private driveway classes as a public place.

In addition, Section 5a (2) provides the following statutory defence:

"In relation to being in charge of a motor vehicle, a person is not guilty if they prove that the circumstances were such that there was no likelihood of them driving the vehicle whilst the proportion of alcohol in their breath, blood or urine exceeded the prescribed limit."

Not my area of law but keys not in the car I reckon is pretty safe. Keys in the car but not in the ignition? Debatable. Sleeping in the back? Not clear cut but certainly arguable. What's not debatable or arguable is getting a good lawyer with the relevant experience should you need it!

Interesting. But accessibility doesn't define a public place, plenty of case law on that. For example, company car parks intended for use only by staff and customers is not a public place. Or a community centre car park, or an internal roadway on a university campus. The purpose of access is key. If access is intended for private purposes only then it's not a public place. If use of the land is intended to be used by the public, or its use by the public is tolerated then it's public land. That's the principle, each case will turn on the facts. I'm confident my driveway is not public land!

Technically you could be done sleeping in your camper van under this law. However if the keys were not in the ignition, the curtains closed, and you were in the sleeping area, it's clear there is no intent to drive.
